1. Introduction

Welcome to AirTerminal ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the AirTerminal high-frequency trading analysis platform, including our website, desktop applications, and related services (collectively, the "Service").

By accessing or using the Service, downloading our software, or creating an account, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Definitions

"Account" means a unique account created for you to access our Service or parts of our Service.

"Platform" refers to the AirTerminal desktop application and associated software tools for trading analysis.

"Subscription" refers to the recurring payment plan that grants you access to premium features of the Service.

"Market Data" refers to real-time and historical trading data, order book information, and related financial market information provided through our Service.

"User" refers to the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

3. Account Registration and Eligibility

To use certain features of the Service, you must register for an Account. You must provide accurate, current, and complete information during the registration process and keep your Account information up-to-date.

You must be at least 18 years old and legally capable of entering into binding contracts to use our Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account.

4. Subscription and Payments

AirTerminal offers both free trial and paid subscription plans. Paid subscriptions provide access to advanced features including real-time market data, multi-exchange support, and professional trading tools.

Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on the plan you select. At the end of each billing period, your subscription will automatically renew under the same conditions unless you cancel it or we cancel it.

You may cancel your subscription at any time through your account management page or by contacting our customer support team. Cancellation will take effect at the end of your current billing period.

All payments are processed securely through our payment processor. By providing your payment information, you authorize us to charge your payment method for the subscription plan you have selected. Refunds are provided at our discretion and in accordance with our refund policy.

5. Software License and Usage

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the AirTerminal desktop application on devices you own or control.

You may not: (a) modify, reverse engineer, or create derivative works of the software; (b) distribute, sell, lease, or sublicense the software; (c) remove or alter any proprietary notices; or (d) use the software for any unlawful purpose.

6. Market Data and Trading Information

Our Service provides access to real-time and historical market data from various cryptocurrency exchanges. This data is provided for informational and analytical purposes only.

7. Prohibited Uses

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal trading activities or market manipulation
• Attempt to interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service
• Use any robot, spider, or other automatic device to access the Service for unauthorized data extraction
• Redistribute, resell, or provide access to market data to third parties without authorization
• Use the Service to violate any applicable securities laws or exchange regulations
• Introduce any viruses, malware, or other harmful code to the Service

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of AirTerminal and its licensors. The Service is protected by copyright, trademark, and other applicable laws.

Our trademarks, trade names, and logos may not be used in connection with any product or service without our prior written consent. You are granted only the limited license set forth in these Terms to use the Service.

10. Disclaimer of Warranties

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, that any errors or defects will be corrected, or that the Service is free of viruses or other harmful components.

You should carefully consider whether trading is suitable for you in light of your circumstances, knowledge, and financial resources.

11. Limitation of Liability

In no event shall AirTerminal, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, trading losses, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Termination

We may terminate or suspend your Account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice on our website prior to the changes becoming effective.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
